Digitalis is a social media management platform that allows users to connect their social media accounts (including TikTok, Instagram, X, LinkedIn, YouTube, and others) in order to schedule, publish, and analyze content from a single dashboard.
You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using the Service, you represent that you have the legal capacity to enter into these Terms.
To use most features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
The Service allows you to connect third-party accounts (such as TikTok) via OAuth authorization. By connecting an account, you grant Digitalis permission to access and act on that account only within the scopes you authorize (for example, uploading and publishing videos on your behalf). You can revoke this access at any time from the third-party platform's settings or from your Digitalis account.
Your use of any third-party platform remains subject to that platform's own terms of service and privacy policy.
You retain ownership of all content you upload, post, or publish through the Service ("User Content"). You grant Digitalis a limited, non-exclusive license to process, store, and transmit your User Content solely for the purpose of operating the Service (e.g., scheduling and publishing posts to connected platforms).
You are solely responsible for your User Content and confirm that it does not infringe any third-party rights or violate any laws or platform policies.
You agree not to use the Service to:
All rights, title, and interest in the Service (excluding User Content) are and will remain the exclusive property of Digitalis and its licensors. Nothing in these Terms transfers any of those rights to you.
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or use the Service in a way that may cause harm to us or to other users.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific results will be achieved.
To the maximum extent permitted by law, Digitalis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
We may update these Terms from time to time. Material changes will be communicated through the Service or via email. Continued use of the Service after such changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of the Republic of Senegal. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Dakar, Senegal.
